Terms of Service

These terms govern use of the Tivoli website. Property-specific booking, event and reservation terms are provided separately and form part of the relevant transaction.

1. Scope and contracting entity

These Terms apply when you browse or interact with thetivolihotels.com. A room reservation, event booking, dining reservation or other paid service may be supplied by the Tivoli group entity or property identified in the quotation, booking page, confirmation or contract. Those transaction-specific terms control if they conflict with these website Terms.

2. Eligibility and authority

You may browse the website at any age. To make a binding reservation or contract, you must be at least 18 years old and legally capable of entering that transaction, or act through a parent, lawful guardian or duly authorised representative.

3. Website information and availability

We aim to keep property descriptions, photographs, facilities, availability and indicative pricing accurate. They may change, and an enquiry does not reserve a date, room or venue. A booking becomes binding only when the responsible Tivoli entity issues confirmation and any required payment or deposit is received.

4. Reservations, prices and payment

Room availability and online reservations may be provided through SwiftBook or another identified booking provider. The final booking screen or written quotation will state the applicable price, taxes, deposit, inclusions and payment schedule. You must review those details before confirming payment.

5. Cancellation, modification and refunds

Cancellation, modification, refund, no-show and force-majeure terms vary by property, rate, event and package. The specific terms shown before booking and recorded in your confirmation or signed event contract apply. Nothing in these Terms limits a mandatory right or remedy available under applicable consumer law.

6. Enquiries and event proposals

A website enquiry or callback request is an invitation to discuss availability and requirements; it is not an offer, booking or price guarantee. Event scope, capacity, services, vendor access, deposits, cancellation terms and other commercial details become binding only through an accepted written quotation or contract.

7. Acceptable website use

You must not submit false information, interfere with website security, introduce malicious code, attempt unauthorised access, infringe another person’s rights, or use automated extraction in a manner that disrupts the website or violates applicable law.

8. Intellectual property

Website text, branding, photographs, graphics, video and software are owned by or licensed to the relevant Tivoli entity. You may view and use the website for personal, non-commercial purposes. You may not reproduce, sell, modify or commercially exploit protected content without written permission, except where law permits.

9. Third-party services and links

The website may link to or load services operated by third parties, including booking, maps, video, virtual-tour and social-media providers. Their terms govern your direct use of their service. Tivoli is not responsible for an external service outside its reasonable control, but this does not limit Tivoli’s responsibility for processors acting on its behalf under applicable data-protection law.

10. Privacy and optional choices

Our Privacy Notice explains how personal data is processed, and the Cookie and storage policy explains browser storage and external services. Merely browsing the website does not constitute consent to an optional processing purpose. Where consent is required, Tivoli requests it separately through a clear affirmative action, and you can later review or withdraw it through Privacy preferences.

11. Website availability

We may maintain, update, suspend or discontinue website features. We do not guarantee uninterrupted availability, particularly where interruption results from maintenance, connectivity, security events or a third-party service outside reasonable control.

12. Responsibility and liability

To the extent permitted by law, Tivoli is not responsible for indirect or consequential loss arising solely from use of the public website. Nothing in these Terms excludes or restricts liability, rights or remedies that cannot lawfully be excluded, including applicable consumer rights or liability arising from fraud or wilful misconduct.

13. Changes to these Terms

We may update these Terms prospectively by publishing a new effective date and version. A material update does not retrospectively change an already confirmed booking or signed event contract unless the parties agree or the law requires it.

14. Governing law and disputes

These Terms are governed by Indian law. Subject to any mandatory consumer forum or jurisdiction available to you, disputes concerning the website are subject to the courts and competent forums in Delhi, India. Please contact Tivoli first so that we can attempt to resolve the concern.
